With the introduction of the Critical Entities Resilience Act (WWKE), cybersecurity and physical security in vital sectors are being more strictly regulated. The law requires organizations in at least the following sectors to better protect themselves against targeted attacks, sabotage, and cyber incidents:

  • Financial market infrastructure
  • Healthcare

If you are on the list, you need to take action

The responsible minister conducts a sectoral risk assessment and determines which organizations provide essential services and are considered critical entities. These organizations are then classified as such not only under the Critical Entities Resilience Act, but also under the Cybersecurity Act. The relevant organizations are informed by the ministry, after which they must carry out a risk assessment within 9 months of designation. Within 10 months of designation, these organizations must comply with the duty of care and reporting obligations. Based on the law, you must be able to demonstrate that you have taken the appropriate measures in a timely manner.

What are critical entities?

The National Coordinator for Counterterrorism and Security states on its website NCTV which criteria are applied in the implementation of the Critical Entities Resilience Act:

  • The organization provides one or more essential services. These are services that are crucial for the maintenance of vital societal functions, vital economic activities, public health and safety, or the environment.

  • The organization operates in the Netherlands and its critical infrastructure is located in the Netherlands. This means, firstly, that the organization with its critical infrastructure is wholly or partly active on the territory of the Netherlands (including airspace and maritime inland waters and territorial sea), and secondly, that the activities of the organization are necessary to provide the essential service or services.

  • An incident within this entity would have significant disruptive effects on the provision of the essential service(s) or, through cascade effects, on other essential services. A cascade effect refers to an unforeseen chain of events that occurs when an event in one system has a negative impact on other, related systems.

Organizations that have already been designated as a vital provider by a relevant minister and fall within one of the above-mentioned sectors are also expected to be designated as a critical entity.
